Unique Vessel / Water Experience Rental Agreement & Liability Waiver

1. RENTAL / EXPERIENCE. The Operator agrees to provide the unique watercraft or water experience (including but not limited to: tiki boats, airboats, eFoils, floating aqua parks, glass-bottom boats, cycle boats, flyboards, Seabobs, hovercrafts, parasailing, or other specialty watercraft/experiences as specified) to the Renter/Participant for the agreed duration and terms.

2. SPECIALIZED NATURE. The Renter/Participant acknowledges that this watercraft or experience is specialized and may involve unique risks not present in conventional boating. The Renter/Participant agrees to: (a) attend any required safety briefing or training session; (b) follow all instructions from the Operator or guide at all times; (c) use all required safety equipment as provided; (d) disclose any medical conditions, physical limitations, or disabilities that may affect safe participation; (e) not participate under the influence of alcohol or drugs.

3. OPERATOR RESPONSIBILITIES. If this is a crewed/guided experience, the Operator will provide a qualified operator or guide. If this is a self-operated rental, the Operator will provide a thorough orientation, safety briefing, and demonstration before the Renter takes possession of the watercraft.

4. WEATHER & CONDITIONS. The Operator reserves the right to cancel, modify, or terminate any rental or experience due to weather, water conditions, mechanical issues, or safety concerns at the Operator’s sole discretion. If cancelled by the Operator before departure, a full refund will be issued.

5. PAYMENT & CANCELLATION. Payment terms and cancellation policies are set by each individual Operator and displayed during booking.

6. ASSUMPTION OF RISK. I understand that unique watercraft and water experiences involve inherent and heightened risks including but not limited to: drowning, capsizing, collision, falling from height (flyboards, parasailing), high-speed operation (eFoils, airboats, Seabobs), equipment malfunction, wildlife encounters, propeller or fan injuries, sun/heat exposure, and personal injury or death. These activities may involve risks beyond those found in conventional boating. I VOLUNTARILY ASSUME ALL SUCH RISKS, known and unknown, and release Pine Key Tampa Bay LLC, Beer Can Island Owners Club LLC, Tiki Bay Island LLC, and all of their respective owners, members, managers, officers, directors, board members, shareholders, equity holders, employees, agents, contractors, affiliates, successors, assigns, heirs, executors, family members, and insurers (collectively, the "Protected Parties") from any and all liability for injury, death, or property damage arising from this rental or experience, whether caused by negligence or otherwise.

7. PHYSICAL REQUIREMENTS. Some unique watercraft and experiences may have minimum age, weight, height, or physical fitness requirements as specified by the Operator. The Renter/Participant represents that they meet all stated requirements and are physically capable of safe participation.

8. DAMAGE & LOSS. The Renter/Participant is financially responsible for any damage to, loss of, or theft of rented equipment beyond normal wear and tear, up to the full replacement value as determined by the Operator.

9. INDEMNIFICATION. I agree to indemnify and hold harmless all Protected Parties from any claims, costs, or damages arising from my participation in or use of the rented watercraft or experience.

10. INSURANCE. Neither BCI nor any Protected Party provides any insurance coverage of any kind. The Renter/Participant is solely responsible for personal health, accident, and liability insurance.

11. PLATFORM DISCLAIMER. Beer Can Island Owners Club LLC, Pine Key Tampa Bay LLC, and Tiki Bay Island LLC (collectively, "BCI") act solely as a booking platform. BCI does not own, operate, inspect, or control any watercraft, equipment, or experience listed on the platform and assumes no liability for the safety, condition, or performance of any listed watercraft, equipment, experience, or operator.

12. PHOTO/MEDIA RELEASE. I grant the Operator and BCI a non-exclusive, royalty-free license to use any photos or video taken during the rental or experience for promotional purposes.

13. GOVERNING LAW. Governed by Florida law. Disputes resolved in Hillsborough County. Jury trial and class action rights waived.
