Terms of Service

Effective March 24, 2026

"Protected Parties" means Pine Key Tampa Bay LLC, Beer Can Island Owners Club LLC, Tiki Bay Island LLC, and all of their respective owners, members, managers, officers, directors, board members, shareholders, equity holders, employees, agents, contractors, affiliates, successors, assigns, heirs, executors, family members, and insurers.

Release of Claims

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE any and all Protected Parties from any and all liability, claims, demands, actions, and causes of action arising from your use of the Platform, any membership, any charter activity, any visit to Pine Key, any property damage, personal injury, illness, or death, whether caused by negligence or otherwise.

Hold Harmless

You agree to defend, indemnify, and hold harmless all Protected Parties from any claims, damages, losses, costs, and expenses arising from your use of the Platform or participation in any activity.

Limitation of Liability

In no event shall any Protected Party be liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed the amount paid in the 12 months preceding the claim.

Dispute Resolution

Governed by Florida law. Hillsborough County jurisdiction. Jury trial waived. Class action waived. Claims must be filed within 1 year.

Platform Disclaimer

BCI operates a booking platform connecting customers with independent charter operators. BCI does NOT own, operate, or control any vessel, equipment, or service. BCI provides ZERO insurance coverage of any kind. BCI is not liable for refunds once payments are transferred to service providers.

Boats for Sale Marketplace

BCI is a listing platform only for the boats-for-sale marketplace. We do not verify vessel condition, handle payments, or mediate transactions between buyers and sellers. Always inspect vessels in person before sending payment.

Events Platform

For Trip Events, funds are held by BCI until the organizer books a charter, at which point they are transferred. For Social Events with ticket sales, revenue goes directly to the event creator's payment account. BCI charges a $1.25 service fee per paid ticket sold. The service fee is non-refundable.

Donations

Events may accept donations from attendees and non-attendees. BCI retains a 10% platform fee on all donations. Donations are processed by Stripe and transferred to the event organizer's connected payment account. BCI does not hold or manage donation funds beyond initial processing.

TAX NOTICE: Funds received through donations, ticket sales, crowdfunding, or any event proceeds on this platform may be considered taxable income by the Internal Revenue Service (IRS). Event organizers and recipients of funds are solely responsible for tracking, reporting, and paying any applicable taxes on income received through the platform. Beer Can Island (Pine Key TampaBay LLC / Beer Can Island Owners Club LLC) does not provide financial, tax, or legal advice. BCI does not issue 1099 forms for event proceeds and does not report event earnings to the IRS. You should consult a qualified tax professional or accountant regarding your tax obligations.
